Terms and Conditions for PixelCheck Open Beta

1. Introduction and Acceptance of Terms

Welcome to the PixelCheck Open Beta Program (the "Beta Program")! These Terms and Conditions ("Terms") govern your access to and use of the PixelCheck AI-powered CS2 item price checking tool and related services (collectively, the "Service") provided by PixelFlip s.r.o. ("PixelFlip," "we," "us," or "our"), a company registered at Rybná 716/24, 110 00 Praha 1, Czech Republic.

By accessing or using the Service, including joining our designated Discord server for the Beta Program, you agree to be bound by these Terms and our Privacy Policy (available at our Privacy Policy). If you do not agree to these Terms, do not use the Service.

2. The Service (PixelCheck Open Beta)

PixelCheck is an innovative tool powered by Artificial Intelligence designed to provide price estimations for Counter-Strike 2 (CS2) in-game items. The Service is currently offered in an open beta, pre-launch state. This means the Service may contain bugs, errors, and inaccuracies, and may experience performance issues or interruptions. Features and functionality may change without notice.

For the purpose of this Beta Program, your access to the Service may be linked to your Discord identity. You are responsible for maintaining the confidentiality of any access credentials and for all activities that occur under your access.

5. License to Use the Service

Subject to your compliance with these Terms, PixelFlip grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service solely for your personal, non-commercial evaluation purposes during the Beta Program.

6. Acceptable Use and User Conduct

You agree not to use the Service to:

• Engage in any illegal activities or transmit any illegal content.
• Violate the rules of our Discord Server.
• Transmit any viruses, malware, or other harmful code.
• Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying ideas or algorithms of the Service.
• Interfere with or disrupt the integrity or performance of the Service or its data.
• Use the Service for any commercial purpose beyond evaluating its potential for your own future business use, or resell, rent, lease, or otherwise provide access to the Service to any third party without our express written permission.
• Use any automated GFNs (bots, scrapers) to access or extract data from the Service without our express written permission.
• Misrepresent item prices or data obtained from the Service, or use it to mislead others.

You expressly understand and agree that:

• The Service is provided on an "as is" and "as available" basis. PixelFlip s.r.o. expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• PixelFlip s.r.o. makes no warranty that (i) the Service will meet your requirements; (ii) the Service will be uninterrupted, timely, secure, or error-free; (iii) the results that may be obtained from the use of the Service (including price estimations) will be accurate, complete, or reliable; or (iv) any errors in the software will be corrected.
• You acknowledge that the Service is a beta product and may be unstable, incomplete, and contain bugs and errors. Price estimations are for informational purposes only and should not be solely relied upon for financial decisions.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall PixelFlip s.r.o., its affiliates, directors, employees, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service (including reliance on price estimations); or (iv) unauthorized access, use, or alteration of your transmissions or content, even if PixelFlip s.r.o. has been advised of the possibility of such damages. In no event shall PixelFlip s.r.o.'s aggregate liability for all claims relating to the Service exceed one hundred Czech Koruna (100 CZK) or the minimum amount allowed by law.

11. Modifications to Terms or Service

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide notice, which may include sending an email to the email address associated with your waiting list subscription or posting a notice on our Discord Server. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised Terms.

We also reserve the right to modify, suspend, or discontinue the Service (or any part or content thereof) at any time with or without notice to you, particularly given its beta nature.

12. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts located in Prague, Czech Republic.

13. Future Commercial Service

You acknowledge that PixelFlip s.r.o. intends to offer a commercial version of the Service in the future, which may be subject to different terms and conditions, including subscription fees. Participation in the Beta Program does not grant any rights to future commercial services or any specific terms for such services.
